Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and News Tracker AI (“News Tracker AI”, “we”, “us”, or “our”) and govern your access to and use of newstrackerai.com and any related products, features, content, and services (collectively, the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least the age of majority in your jurisdiction (and in any event at least thirteen (13) years old, or sixteen (16) in the EEA) and legally capable of entering into a binding agreement to use the Service. You agree to provide accurate registration information, to keep it current, and to safeguard your credentials. You are responsible for all activity under your account. Notify us promptly at contact@newstrackerai.com if you suspect any unauthorized use.

2. The Service

The Service aggregates publicly available news and related public data, applies artificial intelligence to summarize, classify, and organize that information, and presents it through topic-based timelines, summaries, and related features. Features may be added, modified, or removed from time to time. We may also offer experimental or “beta” features at our discretion; such features are provided “as is” and may be unstable, changed, or withdrawn at any time without notice.

3. Acceptable use

You agree not to:
  • Use the Service in violation of any applicable law, regulation, or third-party right.
  • Reverse-engineer, decompile, scrape beyond ordinary product use, probe, or interfere with the Service or its underlying systems.
  • Use the Service to send spam, malware, harassing or unlawful content, or to infringe intellectual property or privacy rights.
  • Republish, redistribute, or resell AI-generated outputs as if they were independent original reporting, or in any way that misrepresents their source.
  • Circumvent plan limits, rate limits, or access controls, including by creating multiple accounts.
  • Use the Service to develop, train, or evaluate competing products without our prior written consent.
  • Use the Service in any country, region, or by any party subject to comprehensive sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”) or equivalent authorities.

4. Subscriptions, billing, and renewals

We offer one or more free and paid subscription tiers. Specific plan features and limits are described in the product and may change from time to time. Paid subscriptions are processed by a third-party payment processor and are billed in advance for the applicable billing period.
  • Paid subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled.
  • You may cancel at any time. Cancellation takes effect at the end of the current billing period; you retain paid features until then and revert to the free tier afterwards.
  • We may change prices, plan features, or plan limits with reasonable advance notice. Material price increases for existing subscribers will take effect at the next renewal following at least thirty (30) days’ notice.
  • You are responsible for all applicable taxes and fees.

5. Refunds, trials, and chargebacks

Except where required by applicable law, all payments are non-refundable and we do not provide partial refunds, prorations, or credits for unused time, downgrades, or features you do not use.
  • Errors. If you believe a charge is the result of a billing error, contact us within thirty (30) days of the charge and we will review it in good faith.
  • Free trials. If a free trial is offered, you must cancel before the trial ends to avoid being charged. We may modify or discontinue trials at any time.
  • Statutory rights (EEA / UK). Where you have a statutory right of withdrawal under EU or UK consumer law, we honor that right. Because the Service consists of digital content and services delivered immediately upon purchase, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun with your consent.
  • Chargebacks. Initiating a chargeback or payment dispute without first contacting us may result in immediate suspension or termination of your account and may be treated as a breach of these Terms.

6. Service availability and changes

We strive to provide a reliable Service but do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We may schedule or perform maintenance, modify or discontinue features, or restrict access at any time, with or without notice. Service outages, degradations, slowdowns, or temporary unavailability do not entitle you to a refund, credit, or other remedy, except where required by applicable law. We are not liable for any failure or delay in the Service caused by events outside our reasonable control, including but not limited to outages or changes at upstream providers, network or internet failures, denial-of- service attacks, regulatory action, labor disputes, or force majeure events.

7. AI-generated content

The Service uses artificial intelligence and large language models to produce summaries, classifications, forecasts, and other outputs. AI outputs may contain errors, omissions, fabrications (“hallucinations”), out-of-date information, or biased framing. AI outputs are provided for informational purposes only and do not constitute professional advice of any kind, including legal, medical, financial, investment, accounting, or tax advice. You should independently verify any information that is important to you before acting on it. We do not warrant the accuracy, completeness, currency, suitability, or reliability of any AI-generated output.

8. Financial and stock-related information

Where the Service displays stock symbols, market data, price changes, or related financial information, that information is provided for general informational purposes only and is not investment advice. News Tracker AI is not a registered investment adviser, broker-dealer, or financial advisor in any jurisdiction. The Service does not make recommendations to buy, sell, or hold any security, commodity, derivative, cryptoasset, or other financial instrument. Market data may be delayed, inaccurate, or incomplete, may originate from third-party providers, and is not guaranteed for trading purposes. You are solely responsible for your investment decisions and accept all risk of loss. Past performance and historical price movements are not indicative of future results.

9. Third-party content and sources

The Service surfaces content from third-party publishers, aggregators, and public data sources. We do not own that content and do not endorse it. Third-party content is subject to its publishers’ own terms and copyrights. We make reasonable efforts to attribute and link to original sources, but we are not responsible for the content, accuracy, legality, or availability of third-party material.

10. Intellectual property

The Service, including its software, design, prompts, models we create, and the unique compilation, organization, and presentation of content, is owned by us or our licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, internal, non-commercial purposes. All rights not expressly granted are reserved.

11. Your content; license to us

You retain ownership of any text or other content you submit to the Service (“Your Content”). By submitting Your Content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, transmit, process, modify (for formatting and operational purposes), and display Your Content as reasonably necessary to operate, secure, and improve the Service and provide it to you. You represent that you have all rights necessary to grant this license.

12. Feedback

If you submit ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use them for any purpose without compensation or attribution.

13. Copyright and DMCA

We respect intellectual property rights and respond to notices of alleged copyright infringement consistent with the U.S. Digital Millennium Copyright Act and similar laws. To submit a takedown notice or counter-notice, see our DMCA / Copyright page. Repeat infringers may have their accounts terminated.

14. Suspension and termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us or others, or if our provision of the Service to you is no longer commercially viable. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, indemnification, limitations of liability, and dispute resolution.

15. Disclaimers

THE SERVICE AND ALL CONTENT, FEATURES, AND OUTPUTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, SECURE, OR UNINTERRUPTED.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD 100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be excluded under applicable law.

17. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless News Tracker AI and its officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms or applicable law, or (d) your infringement of any third-party right.

18. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, government action, natural disaster, labor dispute, internet or telecommunications failure, third-party service interruption, or other force majeure event.

19. Dispute resolution

Informal resolution. Before filing any formal proceeding, you agree to first contact us at contact@newstrackerai.com and attempt in good faith to resolve the dispute for at least thirty (30) days.

Arbitration (United States). If you reside in the United States, you and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by a recognized arbitration provider under its then-current consumer rules, and not by class, collective, or representative action. Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property or unauthorized-access claims, and either party may bring qualifying claims in small-claims court. You have the right to opt out of this arbitration provision within thirty (30) days of first accepting these Terms by sending notice to contact@newstrackerai.com.

Class action waiver (United States). To the extent permitted by law, you and we waive any right to participate in a class, collective, consolidated, or representative action against the other.

EEA, UK, and other jurisdictions. If you reside in a jurisdiction whose mandatory law does not permit binding consumer arbitration or class-action waivers, those provisions do not apply to you. Such disputes will be resolved by the courts of competent jurisdiction in your country of residence or as otherwise required by mandatory local law, and you retain all rights granted by your local consumer-protection laws.

20. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles, except that consumers domiciled in a jurisdiction whose mandatory law would otherwise apply (including, where relevant, the law of their EEA member state, the United Kingdom, or other applicable jurisdiction) retain the protections of that mandatory law.

21. Export controls and sanctions

You represent that you are not located in, and will not use the Service in or for the benefit of, any country or party subject to comprehensive U.S. or other applicable sanctions, and that you are not on any restricted-party list. You will comply with all applicable export-control and sanctions laws.

22. Modifications to these Terms

We may revise these Terms from time to time. The updated version will be posted with a new “Last updated” date. Material changes will be communicated by reasonable means, which may include email or in-product notice. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

23. Miscellaneous

These Terms, together with the Privacy Policy, the Cookie Policy, the DMCA / Copyright page, and any plan-specific or feature-specific notices, form the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any right is not a waiver of that right. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
